The following terms and conditions represent the basis upon which driving lessons and courses are offered to you by your local Top Pass Driving instructor. Please be aware the contract for service is between yourself and the local Top Pass Driving School instructor.
Your instructor
Your driving instructor is an independent self-employed franchisee of Top Pass Driving School.
Any issues must be taken up directly with the instructor you are booking and taking lessons with. If a dispute does not get resolved, Top Pass Driving School will assist the pupil by taking the complaint to the DVSA. The DVSA is responsible for the instructors conduct and teaching license as all driving instructors are signed to the DVSA Code of Conduct.
Lessons
You must hold a current, valid driving licence, provisional, full or international and produce it on your first driving lesson. You must be fit to drive with regard to legal and medical requirements. Including, being able to read a number plate at a distance of 20.5 metres (i.e. 67 feet - about 5 car lengths) with prescribed visual aids (i.e. contact lenses or glasses) if normally worn.
The contract for driving tuition is solely between you and you’re driving Instructor. You and your Instructor are responsible for agreeing all matters relating to the timing, location and duration of individual lessons. All driving lessons booked with him/her constitute an agreement between the instructor and the pupil.
The pupil will be expected to have regular weekly driving lessons.
You must be fit to drive with regard to legal and medical requirements.
Where Top Pass Driving School makes bookings with, or supplies any information or documentation to you, or receives any payments for your lessons, they act as the agent of your Instructor. Please note all driving schools in the UK operate in this way with self employed driving instructors. Top Pass Driving School will not be held responsible for any disputes or refunds.
A suitable car will be provided for training, which is insured, taxed and has a valid MOT certificate (if required). The vehicle will be fitted with dual controls for your safety and regularly serviced to the manufacturers servicing schedule.
Payments and lesson bookings
You must pay for driving lessons in advance by using one of the following methods: payment by debit card or payment by cash directly to Your Instructor.
Top Pass Driving School has no responsibility or liability to you for payments made by other means, and further more if you do pay your Instructor directly by cash, card payment. Top Pass Driving School accepts no responsibility for any payments made direct to Instructors and will not be responsible for any monies or refunds owed to you by your instructor.
Intensive courses
Block booking must be paid in advance! Cancellation of any other booked lessons less than 48 hours notice will be charged with a cancellation fee of 2 hours lesson.
Should a client cancel the course for whatever reason, no refund of the payment will be returned to the purchaser. The booking is a binding contract between the instructor and pupil, once paid, you have agreed to the contract.
Cancellations
Cancellations must be made 48 hours before the time of the lesson, or the normal lesson fee will be charged unless a doctor’s certificate can be produced. You must make the cancellation directly with the instructor you are taking lessons with as you would have booked the lesson directly with them.
Cancellations cannot be made on Sundays or bank holidays as these are deemed as none working days.
Your instructor reserves the right to postpone lessons in certain circumstances, i.e. dangerous weather conditions, test cancellations, mechanical breakdown or illness. In the event of postponement, fees paid in advance will be carried forward.
